Telegram chats as evidence: what an expert can do
Telegram is routinely treated as “another WhatsApp”, and almost everything taken for granted on that basis turns out to be wrong: where the messages live, what survives a deletion, who an account belongs to. Anyone who needs to produce — or to challenge — a Telegram conversation in court needs to know the physics of this particular system, because it differs from all the others.
Two systems in one: cloud chats and secret chats
The first thing to know is that Telegram contains two different messaging systems with opposite properties. Ordinary chats — the ones opened by default, plus groups and channels — live on the operator's servers, encrypted in transit between device and server but readable by the server itself: that is what allows the entire history to reappear when the account is accessed from a new phone. Secret chats, which must be opened deliberately, are encrypted end-to-end and exist only on the two devices that established them: they do not synchronise, do not pass through the cloud, and do not appear on the account's other devices.
Nearly every question that matters in litigation — can it be recovered? from where? what is left? — has two different answers depending on the kind of chat. The first step in any forensic examination of Telegram is therefore to establish which of the two species the disputed conversation belongs to.
What can be recovered, and from where
For ordinary chats, synchronisation works in favour of whoever is searching: the conversation is not merely on the phone, it is on the account. A tablet or computer linked to the same account holds a copy; even a device linked afterwards, while the credentials are available, downloads the history from the cloud. It is the opposite of WhatsApp, where the archive lives on the device and recovery goes through backups — I have written about this in recovering deleted messages.
For secret chats the opposite rule applies: they exist only where they were born. No cloud, no other devices, no official export; if the chat carried a self-destruct timer, not even the device keeps the messages beyond the set term. Whatever remains must be sought on the handset itself — application archives, notifications retained by the operating system — within the narrow windows and limited guarantees of any on-device recovery.
Messages deleted “for everyone”
Here lies the biggest trap. Telegram allows either participant to delete a message — or an entire conversation — for both sides, at any time and without leaving a placeholder: no “this message was deleted” notice; the chat closes up as if the message had never existed. And because ordinary chats live in the cloud, the deletion propagates: it disappears from the other party's phone, from their tablet, from their computer, and from the servers.
The practical consequence is that WhatsApp's main road — “the chat also lives on the other person's device” — is not guaranteed on Telegram: the other side may have made it vanish from both ends. What remote deletion does not reach are the copies that left the system beforehand: an export already made, a device backup containing the application's cache, notifications logged by the operating system. Anyone who fears the disappearance of a conversation they need has one wise move: have it acquired at once, while it still exists.
Whose account is it: the attribution problem
On WhatsApp the counterpart is a telephone number, and a number — for all its limits — leads to a contract. On Telegram there may be nothing of the kind: an account can expose only a freely chosen username, keep its number hidden from everyone, and change username and display name at will. In a dispute this shifts the centre of gravity: beyond proving what was written, it is often necessary to prove who wrote it, and attribution has to be built from surrounding elements — the number, where visible or saved in the contacts; the account's internal numeric identifier, which does not change when the username does; the content of the conversation itself; convergences with other channels.
This point deserves early attention, because it shapes strategy: a perfectly acquired conversation attributed merely to “a username” leaves the opposing party a ground of challenge that other systems simply do not offer.
How a Telegram chat is acquired
The screenshot remains the weakest form, for the reasons that hold with every messaging system: it is an image with no parentage, open to disavowal and hard to defend on its own — I have written about this in WhatsApp screenshots in court. The serious routes are two, and on Telegram they are more practicable than elsewhere.
The first is acquisition from the device: extracting the application's archive from the handset, identifying the device and the account, recording the operations and closing with an integrity check on the result. The second, peculiar to Telegram, is the official export offered by the desktop application: it produces a copy of the chat history in a structured, readable format. Performed inside a documented acquisition — on which device, from which account, at what time, with which checks on the result — it yields a representation of the conversation anchored to the account rather than to an image. Performed privately and filed without documentation, it falls back into the limits of any reproduction: the value never lies in the file, it lies in the chain tying it to its origin.
What not to expect from the operator
For ordinary chats the messages do exist on Telegram's servers — so it is natural to ask whether they can be obtained from there. The practical answer, for civil litigation, is no: the operator is established outside the European Union, is not reachable through ordinary disclosure mechanisms, and its cooperation even with public authorities has historically been confined to narrow hypotheses. Building an evidential strategy on the hope of an answer from Telegram's servers means building it on ground that will not hold.
The point in one line
On Telegram, evidence must be taken where it is now — the device, the accessible account, the copies already exported — and taken early, because remote deletion can make it vanish from every device at once. Everything else, from the kind of chat to the attribution of the account, is established case by case.
