Francesco ZinghinìParty-appointed technical expertise

Terms of use

These conditions govern the use of francescozinghini.it. They are written to be read: if anything is unclear, write to me.

1. Who runs this site

The site belongs to Francesco Zinghinì, chartered engineer registered with the Ordine degli Ingegneri della Provincia di Roma under no. 31345, Roma, Italy. Full identifying details and information on the regulated profession are in the legal notice.

2. What it is for, and what it is not for

The content published here is informative and describes, in general terms, technical problems that recur in proceedings where the evidence is digital.

It does not constitute technical or legal advice on any particular case and cannot replace examination of the specific matter. Every situation has its own facts, data and timing, and those change the answer.

Technology and case law evolve: content that was correct at the date of publication may cease to be so. The date of last update appears at the foot of every page that carries one.

3. When a professional relationship arises

No professional relationship arises from consulting this site, from sending a message through the contact form, or from a preliminary exchange of email. An instruction is created only by written agreement between the parties, setting out scope, activities, timing and fees.

Until that agreement exists, what we write to each other remains an exploratory contact: no obligation as to result and no contractual confidentiality undertakings arise — although I treat every piece of information received with due discretion.

4. Use of the contact form

The form is an ordinary channel, not a secure one. Please do not include special category data, criminal-offence data, third-party names or confidential documents: for the substance of the matter we move to certified email or another agreed channel.

Using the form for automated submissions, unsolicited commercial communications, or unlawful or abusive content is prohibited. The site applies technical measures against automated use and limits the number of submissions per connection; abuse may result in access being blocked.

5. Intellectual property

The texts, structure, graphic elements and images of this site are the owner's work and are protected by Italian law 633 of 1941 on copyright.

Permitted: quoting passages for purposes of criticism, discussion or teaching, with attribution and a link to the original page — the use the law recognises and one I am glad to see.

Not permitted: reproduction in whole or in substantial part, republication on other sites, or use of the content to train systems that produce a substitute version of it. Crawling for indexing and for answering with attribution is permitted, as stated in the robots.txt file.

The code of the projects listed on the projects page is released under the MIT licence and is governed by its terms, which prevail over this section.

Photographs depicting the owner may not be reproduced without his consent.

6. Links to third-party sites

The site contains links to external resources — specifically the owner's professional profiles and the project repositories — provided for reference. I have no control over those sites and am not responsible for their content, their availability or their data protection practices.

7. Availability and limitation of liability

The site is provided «as is». I take reasonable care that it is available and accurate, but I do not warrant that it will be free of interruptions, errors or inaccuracies.

To the extent permitted by law, I am not liable for loss arising from use of, or inability to use, the site, nor for decisions taken on the basis of its content without examination of the specific matter. Liability for wilful misconduct and gross negligence, which the law does not allow to be excluded, is unaffected, as are the mandatory rights of consumers.

8. Changes

I may amend these terms to reflect changes in the law or in how the site works. The applicable version is the one published at the time of access; the date of last update is at the foot of this page.

9. Governing law and jurisdiction

Use of the site is governed by Italian law. Disputes relating to use of the site fall within the jurisdiction of the courts of Rome, save where the law mandatorily provides otherwise — in particular, in consumer matters, the courts of the consumer's place of residence or domicile.
